Please read these Terms and Conditions carefully. By booking a session, submitting a contact form, or purchasing any service from ClearPath Learning Academy, you acknowledge that you have read, understood, and agree to these terms in their entirety.

1About ClearPath Learning Academy

ClearPath Learning Academy LLC is a Florida limited liability company, formerly registered as Blooming Brains Tutors LLC. ClearPath Homeschool Testing operates as a registered fictitious name under ClearPath Learning Academy LLC. Our goal is to provide high quality, structured instruction that supports measurable student growth. All services are delivered online via Zoom by a Florida Department of Education certified teacher holding an M.Ed. in Reading.

ClearPath Learning Academy is an approved Step Up For Students provider, accepting FES-UA, FES-EO, FTC, and PEP scholarship funds.

2Services Offered

ClearPath Learning Academy offers the following services to homeschool and private school families:

One on one reading and writing tutoring, 50 minute sessions, available singly or as a 4, 8, or 16 Session Package
One on one math tutoring, 50 minute sessions, available singly or as a 4, 8, or 16 Session Package
Writing Assessment and Report, a 60 minute session with a written scored report
Dyslexia Screening and Results Review, including a written summary and a live review with the parent
Renaissance Star Reading and Star Math assessments, included with every tutoring package and also available on their own
Scholarship Navigation Consultation, 30 minutes
Scholarship Navigation Consultation, 1 hour

All sessions are conducted live via Zoom. Private pay services are available to clients regardless of location. Step Up For Students scholarship services are limited to Florida residents in accordance with program requirements.

Assessment included with every package: Every tutoring package begins with a Renaissance Star assessment, Star Reading for reading and writing packages and Star Math for math packages. ClearPath Learning Academy provides the login. It is the client’s responsibility to have the student complete the assessment at home before the first session. Where it has not been completed in time, it is completed during the first session, which uses instructional time from that session.

Weekly progress notes: Each tutoring package includes one written progress note per week for the duration of the package, regardless of how many sessions fall in that week.

Services and pricing are subject to change. Current offerings and current pricing are always reflected on our website and on our booking pages.

3Eligibility & Parental Consent

ClearPath Learning Academy provides online tutoring and educational consultation services to students in Kindergarten through grade 12. Private pay clients may be located anywhere. Step Up For Students scholarship services are available to Florida residents only, in accordance with Step Up For Students program requirements.

By booking or purchasing services, the parent or legal guardian represents and warrants that:

They are the parent or legal guardian of the student receiving services
They have the legal authority to enter into this agreement on behalf of the student
All information provided during booking is accurate and complete
Step Up scholarship clients confirm their student meets all applicable program eligibility requirements

4Payment

Private Pay: Payment is required at the time of booking through Calendly. Payments are processed securely. Sessions are not confirmed until payment is received.

Step Up For Students Scholarships: Families using FES-UA, FES-EO, FTC, or PEP scholarship funds must reserve funds through the EMA Marketplace before scheduling a Calendly session. Scholarship reservations must be completed prior to the session date. ClearPath Learning Academy is not responsible for delays or issues arising from the EMA Marketplace reservation process.

Where a scholarship reservation does not complete: If sessions have been delivered and the corresponding EMA reservation is not completed, is declined, or is later reversed or reallocated, the client is responsible for payment of the sessions already delivered at the standard private pay rate for that service. Remaining sessions are placed on hold until payment or a valid reservation is in place.

Session Packages: Packages are paid in full at the time of booking. Packages are designed to run continuously on a regular weekly schedule, and each package has a completion window: a 4 Session Package must be completed within eight weeks of the first session, an 8 Session Package within twelve weeks, and a 16 Session Package within twenty four weeks. Sessions remaining after that window are forfeited. No partial refunds are available once one or more sessions have been completed.

Sessions added to the end of a package under Section 5, and sessions skipped for a holiday, extend the completion window by the same number of weeks, so an added session is never lost to the window.

5Cancellation, Rescheduling & Missed Sessions

24 Hour Notice Required: Cancellations and reschedules must be made at least 24 hours before the scheduled session start time. To cancel or reschedule, use the link in your Calendly confirmation email or contact us at contact@clearpathlearningacademy.com.

With at least 24 hours notice: the session is rescheduled at no cost and does not count against your package.

With less than 24 hours notice, where you tell us before the session start time: the session is added to the end of your package, at your next regular meeting time after your final scheduled session. This draws on your added session allowance.

Your added session allowance is the total number of late cancellations a package can absorb:

4 Session Package: one added session
8 Session Package: one added session
16 Session Package: two added sessions

The allowance belongs to the package, not to the student or the family. It does not reset partway through a package, it does not carry over into a new package, and unused added sessions are not refunded or credited. Where a family has more than one child enrolled, each child’s package carries its own allowance.

Once a package has used its allowance, any further cancellation with less than 24 hours notice is forfeited. That session is counted as delivered and is not rescheduled or refunded.

No notice and no shows: Where no notice is given before the session start time, or the student does not attend, the session is forfeited. It is counted as delivered, is not added to the end of the package, and does not draw on the added session allowance above. Your child’s time slot is held each week and is not offered to another family, and with no notice at all that time cannot be used.

Single Sessions: A single session may be rescheduled once with at least 24 hours notice. Because there is no package to extend, a cancellation with less than 24 hours notice, or a no show, is forfeited.

Moving a session: Any session may be moved once. A session that has already been moved and is then missed is forfeited.

Holidays: Sessions that fall on a holiday ClearPath Learning Academy observes are not held. The package extends by one session at the next regular meeting time. A skipped holiday session does not count against your package and does not draw on your added session allowance. The dates affected are confirmed with you when your schedule is set at the start of the package.

ClearPath Cancellations: In the event of a genuine emergency on the part of the tutor, including illness, family emergency, or unforeseen circumstance, ClearPath Learning Academy will notify the client as soon as reasonably possible and offer a full reschedule at no penalty. A session cancelled by ClearPath does not count against your package allowance.

Repeated late cancellations: Where late cancellations or no shows become a pattern, ClearPath Learning Academy may decline to continue or renew a package, and will discuss this with the family before doing so.

6Refund Policy

Single Sessions and Consultations: A full refund is available if cancellation is made at least 24 hours before the scheduled session. No refunds are issued for cancellations made less than 24 hours before the session or for no shows. Refunds are not issued for dissatisfaction after a session has been completed.

Assessments: This applies to the Writing Assessment and Report, the Dyslexia Screening and Results Review, and any Star assessment booked on its own. A full refund is available if cancellation is made at least 24 hours before the scheduled appointment. Once the assessment has been administered it is not refundable, including where the written report or summary has not yet been delivered, as the report is produced from work already completed.

Session Packages: This applies to the 4, 8, and 16 Session Packages. A full refund is available before any sessions have been completed. Once one or more sessions have taken place, refunds are not available for completed sessions. Remaining unused sessions may be rescheduled within the completion window described in Section 4 but are not refundable.

Where ClearPath ends services: The one circumstance in which unused sessions are refundable is termination by ClearPath Learning Academy under Section 12 or Section 14. In that case unused sessions are refunded on a prorated basis. Where the client ends services, or where a session is forfeited under Section 5, the terms above apply and unused sessions are not refundable.

Step Up Scholarship Payments: Refund policies for scholarship funded sessions are subject to Step Up For Students program guidelines. Please contact Step Up For Students directly for questions about scholarship fund reallocation.

Refund requests should be submitted by email to contact@clearpathlearningacademy.com. Approved refunds will be processed within five to seven business days.

7Technology & Equipment Requirements

All sessions are conducted via Zoom. It is the client’s responsibility to ensure the following requirements are met before each session:

A laptop or desktop computer with a keyboard and mouse. Much of the work involves writing and moving items on the screen, which is impractical on a touchscreen
A tablet is acceptable only where a keyboard and mouse are paired with it
A stable, reliable internet connection
A functioning camera and microphone
Zoom installed and tested before the session
Devices charged, or connected to power, before the session begins
A quiet, well lit environment free from significant distractions

Brief technical difficulties that are resolved during the session are not treated as a cancellation, and ClearPath Learning Academy will make reasonable efforts to continue or to reschedule. Where a session cannot proceed at all because of technology on the client’s end, it is treated under Section 5 as a cancellation with less than 24 hours notice, and draws on the added session allowance where one remains.

Late Arrival Policy: Sessions will begin and end at the scheduled time. If a student arrives late, the session will still end at the originally scheduled time and will not be extended. Late arrivals are not eligible for a refund or reschedule for the time missed.

Writing Assessment: The Writing Assessment and Report requires a laptop or desktop computer with a physical keyboard. A tablet or phone is not sufficient, because the assessment measures timed, on demand writing. Where a suitable device is not available at the scheduled time the session cannot proceed and is treated under Section 5.

8Session Recordings

ClearPath Learning Academy does not record Zoom sessions. Clients are also prohibited from recording sessions without the express written consent of ClearPath Learning Academy. Unauthorized recording of sessions is a violation of these Terms and Conditions and may result in immediate termination of services without refund.

9Confidentiality & Privacy

All student information, session content, and family details shared with ClearPath Learning Academy are kept strictly confidential. Information will not be shared with any third party except as required by law.

ClearPath Learning Academy collects only the information necessary to provide services, including name, contact details, student grade level, and scheduling information. See our Privacy Policy for full details on how your data is collected, stored, and protected.

10Testimonials & Marketing

ClearPath Learning Academy will never use your name, your child’s name, photos, feedback, or results in any marketing materials without your explicit written consent. You may be asked to provide a testimonial or review at the conclusion of services, but this is entirely voluntary. Any anonymized results used in marketing require prior written permission from the parent or guardian.

11Scope of Services & Limitations

ClearPath Learning Academy provides reading, writing, and math tutoring and educational consultation services. These services are supplemental and educational in nature and do not constitute psychological evaluation, diagnosis, therapy, special education services, or medical advice.

ClearPath Learning Academy does not diagnose learning disabilities, including dyslexia. If you have concerns about a learning disability or require a formal evaluation, please consult a licensed educational psychologist or appropriate specialist.

Results vary by student and depend on factors including attendance, consistency, effort, and practice outside of sessions. ClearPath Learning Academy makes no guarantee of specific academic outcomes, grade improvements, or test score increases.

12Student Conduct & Behavior Expectations

Students are expected to participate respectfully and remain engaged during sessions. ClearPath Learning Academy is committed to providing a safe, focused, and productive learning environment for every student.

Repeated disruptive, disrespectful, or inappropriate behavior during sessions may result in termination of services. In the event of termination due to student conduct, a prorated refund for unused sessions will be issued, as described in Section 6.

13Limitation of Liability

ClearPath Learning Academy shall not be liable for any indirect, incidental, or consequential damages arising from the use of services, including but not limited to loss of anticipated academic outcomes, interruption of service due to technical issues beyond our control, or any other indirect loss.

Our total liability to you for any claim arising from the services shall not exceed the total amount paid by you for the specific session or service at issue.

14Termination of Services

ClearPath Learning Academy reserves the right to terminate services at any time if a client engages in disrespectful, abusive, or inappropriate behavior toward the tutor, fails to comply with technology requirements after reasonable accommodation, or violates these Terms and Conditions.

In the event of termination by ClearPath Learning Academy, a prorated refund for unused sessions will be issued, as described in Section 6.

Clients may terminate services at any time, subject to the refund policy outlined in Section 6.

15Governing Law

These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from these terms or the services provided shall be resolved under Florida law. By booking or purchasing services, you agree to submit to the jurisdiction of the courts of the State of Florida.

16Changes to These Terms

ClearPath Learning Academy reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our services after any update constitutes acceptance of the revised terms.
