Please read these Terms and Conditions carefully. By booking a session, submitting a contact form, or purchasing any service from ClearPath Learning Academy, you acknowledge that you have read, understood, and agree to these terms in their entirety.
1About ClearPath Learning Academy
ClearPath Learning Academy is a DBA of Blooming Brains Tutors LLC, a Florida limited liability company. Our goal is to provide high-quality, structured literacy instruction that supports measurable student growth. All services are delivered online via Zoom by a Florida Department of Education certified teacher holding an M.Ed. in Reading.
ClearPath Learning Academy is an approved Step Up For Students provider, accepting FES-UA, FES-EO, FTC, and PEP scholarship funds.
2Services Offered
ClearPath Learning Academy offers the following services to Florida homeschool and private school families:
- One-on-one reading and writing tutoring sessions (45 minutes, $125 per session)
- 4-Session Tutoring Package (4 x 45-minute sessions, $450)
- Educational Consultation — 30 minutes ($85)
- Educational Consultation — 1 hour ($150)
All sessions are conducted live via Zoom. Private pay services are available to clients regardless of location. Step Up For Students scholarship services are limited to Florida residents in accordance with program requirements. Services and pricing are subject to change. Current offerings are always reflected on our website.
3Eligibility & Parental Consent
ClearPath Learning Academy provides online reading and writing tutoring and educational consultation services to students primarily in grades 3–8, though exceptions may be made on a case-by-case basis. Private pay clients may be located anywhere. Step Up For Students scholarship services are available to Florida residents only, in accordance with Step Up For Students program requirements.
By booking or purchasing services, the parent or legal guardian represents and warrants that:
- They are the parent or legal guardian of the student receiving services
- They have the legal authority to enter into this agreement on behalf of the student
- All information provided during booking is accurate and complete
- Step Up scholarship clients confirm their student meets all applicable program eligibility requirements
4Payment
Private Pay: Payment is required at the time of booking through Calendly. Payments are processed securely. Sessions are not confirmed until payment is received.
Step Up For Students Scholarships: Families using FES-UA, FES-EO, FTC, or PEP scholarship funds must reserve funds through the EMA Marketplace before scheduling a Calendly session. Scholarship reservations must be completed prior to the session date. ClearPath Learning Academy is not responsible for delays or issues arising from the EMA Marketplace reservation process.
5Cancellation & Rescheduling
24-Hour Notice Required: Cancellations and reschedules must be made at least 24 hours before the scheduled session start time.
- Cancellations made 24+ hours in advance: session is rescheduled or refunded per the refund policy below
- Cancellations made less than 24 hours in advance: the session is forfeited and no refund is issued
- No-shows (failure to attend without notice): the session is forfeited and no refund is issued
To cancel or reschedule, use the link in your Calendly confirmation email or contact us at clearpathlearningacademy@gmail.com at least 24 hours before your session.
ClearPath Learning Academy may, at its sole discretion, make exceptions to the 24-hour cancellation policy in extraordinary circumstances.
6Refund Policy
Single Sessions and Consultations: A full refund is available if cancellation is made at least 24 hours before the scheduled session. No refunds are issued for cancellations made less than 24 hours before the session or for no-shows. Refunds are not issued for dissatisfaction after a session has been completed.
4-Session Package: A full refund is available before any sessions have been completed. Once one or more sessions have taken place, refunds are not available for completed sessions. Remaining unused sessions may be rescheduled but are not refundable.
Step Up Scholarship Payments: Refund policies for scholarship-funded sessions are subject to Step Up For Students program guidelines. Please contact Step Up For Students directly for questions about scholarship fund reallocation.
Refund requests should be submitted by email to clearpathlearningacademy@gmail.com. Approved refunds will be processed within 5–7 business days.
7Technology & Equipment Requirements
All sessions are conducted via Zoom. It is the client’s responsibility to ensure the following requirements are met before each session:
- A laptop or desktop computer is strongly recommended for the best session experience
- A stable, reliable internet connection
- A functioning camera and microphone
- Zoom installed and tested before the session
- A quiet, well-lit environment free from significant distractions
If a session cannot proceed due to technology issues on the client’s end and less than 24 hours notice is given, the session may be forfeited. ClearPath Learning Academy will make reasonable efforts to reschedule in the event of brief technical difficulties.
8Session Recordings
ClearPath Learning Academy does not record Zoom sessions. Clients are also prohibited from recording sessions without the express written consent of ClearPath Learning Academy. Unauthorized recording of sessions is a violation of these Terms and Conditions and may result in immediate termination of services without refund.
9Confidentiality & Privacy
All student information, session content, and family details shared with ClearPath Learning Academy are kept strictly confidential. Information will not be shared with any third party except as required by law.
ClearPath Learning Academy collects only the information necessary to provide services, including name, contact details, student grade level, and scheduling information. See our Privacy Policy for full details on how your data is collected, stored, and protected.
10Testimonials & Marketing
ClearPath Learning Academy will never use your name, your child’s name, photos, feedback, or results in any marketing materials without your explicit written consent. You may be asked to provide a testimonial or review at the conclusion of services, but this is entirely voluntary. Any anonymized results used in marketing require prior written permission from the parent or guardian.
11Scope of Services & Limitations
ClearPath Learning Academy provides reading and writing tutoring and educational consultation services. These services are supplemental and educational in nature and do not constitute psychological evaluation, diagnosis, therapy, special education services, or medical advice.
ClearPath Learning Academy does not diagnose learning disabilities, including dyslexia. If you have concerns about a learning disability or require a formal evaluation, please consult a licensed educational psychologist or appropriate specialist.
Results vary by student and depend on factors including attendance, consistency, effort, and practice outside of sessions. ClearPath Learning Academy makes no guarantee of specific academic outcomes, grade improvements, or test score increases.
12Student Conduct & Behavior Expectations
Students are expected to participate respectfully and remain engaged during sessions. ClearPath Learning Academy is committed to providing a safe, focused, and productive learning environment for every student.
Repeated disruptive, disrespectful, or inappropriate behavior during sessions may result in termination of services. In the event of termination due to student conduct, a prorated refund for unused sessions will be issued.
13Limitation of Liability
ClearPath Learning Academy shall not be liable for any indirect, incidental, or consequential damages arising from the use of services, including but not limited to loss of anticipated academic outcomes, interruption of service due to technical issues beyond our control, or any other indirect loss.
Our total liability to you for any claim arising from the services shall not exceed the total amount paid by you for the specific session or service at issue.
14Termination of Services
ClearPath Learning Academy reserves the right to terminate services at any time if a client engages in disrespectful, abusive, or inappropriate behavior toward the tutor, fails to comply with technology requirements after reasonable accommodation, or violates these Terms and Conditions.
In the event of termination by ClearPath Learning Academy, a prorated refund for unused sessions will be issued.
Clients may terminate services at any time, subject to the refund policy outlined in Section 6.
15Governing Law
These Terms and Conditions are governed by the laws of the State of Florida. Any disputes arising from these terms or the services provided shall be resolved under Florida law. By booking or purchasing services, you agree to submit to the jurisdiction of the courts of the State of Florida.
16Changes to These Terms
ClearPath Learning Academy reserves the right to update these Terms and Conditions at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our services after any update constitutes acceptance of the revised terms.
